1. Definitions

  • "User" or "You" refers to individuals using our services or website
  • "We", "Us", or "Our" refers to Kairos
  • "Property" refers to residential properties listed through our service
  • "Agreement" refers to the rental contract between tenant and property owner
  • "Website" refers to our online platform and related digital services

2. Acceptance of Terms

By accessing our website or using our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you should not use our services.

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our services. By using our services, you represent and warrant that you meet these requirements.

3. Service Description

Kairos provides property rental services connecting prospective tenants with available residential properties in Bangkok, Thailand. Our services include:

  • Property listings and information
  • Property viewing coordination
  • Rental application processing
  • Lease agreement facilitation
  • Property management and maintenance coordination
  • Tenant support throughout rental period

Service availability may vary by property and location. We reserve the right to modify or discontinue services with reasonable notice.

4. User Responsibilities

4.1 Information Accuracy

You agree to provide accurate, current, and complete information during the rental application process. You must update information promptly if it changes during your rental period.

4.2 Prohibited Activities

You agree not to:

  • Provide false or misleading information in rental applications
  • Use properties for illegal activities or purposes
  • Sublet properties without written authorization
  • Exceed occupancy limits specified in lease agreements
  • Damage property or fail to report damages promptly
  • Violate building rules or neighborhood regulations
  • Interfere with other residents' peaceful enjoyment

4.3 Property Care

Tenants are responsible for maintaining properties in good condition, reporting maintenance issues promptly, and allowing access for inspections and repairs as specified in lease agreements.

5. Rental Applications and Agreements

5.1 Application Process

Submitting a rental application does not guarantee property approval. Applications are subject to verification, background checks, and property owner approval. Application fees, if applicable, are non-refundable.

5.2 Lease Agreements

Approved applicants will receive a formal lease agreement specifying rental terms, conditions, and responsibilities. Lease agreements are legally binding contracts between tenants and property owners, with Kairos serving as property manager.

5.3 Security Deposits

Security deposits are held in accordance with Thai law and lease agreement terms. Deposits will be returned minus legitimate deductions for damages, unpaid rent, or lease violations, within 30 days of lease termination.

6. Payment Terms

6.1 Rental Payments

Rental payments are due as specified in lease agreements. Accepted payment methods include bank transfer, credit card, and other methods as communicated. All prices are quoted in Thai Baht (฿).

6.2 Late Payments

Late payments may incur fees as specified in lease agreements. Persistent late payment may result in lease termination proceedings.

6.3 Additional Fees

Additional fees for utilities, services, or damages will be communicated clearly. All fees and charges are outlined in lease agreements or service documentation.

7. Property Maintenance and Repairs

We coordinate property maintenance and repairs through established service providers. Response times vary based on issue urgency:

  • Emergency issues: Same-day response for safety hazards, major leaks, or security concerns
  • Urgent issues: Within 24 hours for matters affecting habitability
  • Routine maintenance: Within 3-5 business days for non-urgent matters

Tenants are responsible for damages caused by negligence or misuse. Normal wear and tear is expected and will not be charged to tenants.

8. Lease Termination

8.1 Early Termination by Tenant

Tenants may terminate leases early subject to terms specified in lease agreements. Notice periods and potential fees vary by lease type and duration.

8.2 Termination by Property Owner

Property owners may terminate leases for lease violations, non-payment, property damage, or other causes specified in lease agreements, following proper legal procedures.

8.3 Move-Out Procedures

Upon lease termination, tenants must return properties in good condition, remove all belongings, and participate in move-out inspections. Security deposit refunds are processed after final property assessment.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee:

  • Continuous availability of any specific property
  • Uninterrupted access to our services or website
  • Error-free operation of our systems
  • Specific outcomes from rental applications

While we strive to maintain accurate property information, we do not warrant completeness or accuracy of all listings. Property conditions are subject to verification during viewings.

10. Limitation of Liability

To the maximum extent permitted by Thai law, Kairos shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding fees paid for services
  • Issues arising from tenant-property owner disputes
  • Force majeure events beyond our reasonable control

This limitation applies regardless of the legal theory upon which claims are based.

11. Indemnification

You agree to indemnify and hold harmless Kairos, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms, lease agreements, or applicable laws.

12. Governing Law and Dispute Resolution

These Terms & Conditions are governed by Thai law. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

Before initiating legal proceedings, parties agree to attempt good-faith negotiation to resolve disputes. If negotiation fails, either party may pursue legal remedies through appropriate Thai courts.

13. Intellectual Property

All content on our website, including text, graphics, logos, and software, is owned by Kairos or licensed to us. You may not reproduce, distribute, or create derivative works without written permission.

Property photographs and descriptions are provided for informational purposes and may not be used for commercial purposes without authorization.

14. Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our privacy practices as described in that policy.

15. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Significant changes will be communicated via email to registered users.

Continued use of our services after changes take effect constitutes acceptance of modified terms. If you do not agree with changes, you should discontinue using our services.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and individual lease agreements, constitute the entire agreement between you and Kairos regarding use of our services, superseding any prior agreements.
